1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mofami sp. z o.o. ("Mofami", "we", "us", or "our") governing your access to and use of our website, applications, APIs, and services (collectively, the "Services").

By accessing or using our Services, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security. Mofami will not be liable for any loss or damage arising from your failure to comply with these obligations.

3. Credits and Payments

Our Services operate on a credit-based system. Credits are purchased in advance and redeemed for services. One credit equals €0.10 (EUR) at the base rate. Prices in other currencies are calculated using fixed exchange rates published on our pricing page.

All purchases are final. Credits are non-refundable except as required by law or as outlined in our Refund Policy. Credits do not expire while your account is active. Unused credits may be forfeited if your account is terminated for breach of these Terms.

4. Acceptable Use

You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our infrastructure. Prohibited activities include but are not limited to:

• Violating any applicable laws or regulations
• Infringing intellectual property rights of third parties
• Distributing malware, viruses, or harmful code
• Engaging in unauthorized scraping, data mining, or harvesting
• Impersonating any person or entity
• Attempting to gain unauthorized access to any part of the Services
• Using the Services to generate spam or unsolicited communications

5. Intellectual Property

All content, features, and functionality on our Services — including text, graphics, logos, icons, images, audio clips, and software — are the exclusive property of Mofami or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not reproduce, modify, distribute, or create derivative works from our content without express written permission.

6. User Content

You retain ownership of any content you submit, upload, or transmit through the Services ("User Content"). By providing User Content, you grant Mofami a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, and distribute such content solely for the purpose of operating and improving the Services.

You represent that you have all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

7. Third-Party Services

Our Services may integrate with or contain links to third-party websites, services, or content. We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third parties are governed by their respective terms and policies.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MOFAMI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOFAMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

In no event shall our total liability exceed the amount you paid to Mofami in the twelve (12) months preceding the event giving rise to liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mofami and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the Services at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or us, or for any other reason in our sole discretion.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the competent courts located in Kraków, Poland.

13. Changes to Terms

We may modify these Terms at any time. We will post the revised Terms on this page with an updated effective date. Material changes will be notified via email or a prominent notice on our Services. Your continued use after changes constitutes acceptance.
